These Terms of Service (“Terms”) are a binding agreement between you and IHANDYMAN, a California stock corporation doing business as iHandyman (“iHandyman,” “we,” “us,” or “our”). These Terms govern your access to and use of ihandyman.pro, customer accounts, handyman membership applications and profiles, reviews, problem reports, search, Live Availability, and related services (collectively, the “Service”).
By creating an account, submitting a membership application, posting content, submitting a review or problem report, purchasing or maintaining a membership, or otherwise using an interactive feature of the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the applicable feature of the Service.
1. Eligibility and accounts
You may browse public pages and search for handymen without creating an account. To create an account, submit a review or problem report, post content, apply for handyman membership, complete identity verification, authorize payment, maintain a paid membership, or otherwise use an interactive account feature, you must be at least 18 years old and legally able to enter a binding contract.
You must provide accurate, current information, keep account credentials secure, promptly update information that becomes inaccurate, and notify iHandyman if you suspect unauthorized access. You are responsible for activity conducted through your account, except to the extent caused by iHandyman or otherwise provided by applicable law.
2. What iHandyman is
iHandyman is a membership directory and discovery platform that helps users find and directly contact independent handyman professionals and businesses.
- iHandyman is not the employer, partner, joint venturer, agent, broker, general contractor, or representative of a listed handyman;
- handymen independently decide whether to accept work and independently determine scope, price, schedule, methods, warranties, licensing, insurance, permits, taxes, and payment terms;
- customers and handymen communicate, contract, and pay each other directly;
- iHandyman is not a party to any agreement between a customer and a handyman; and
- iHandyman does not charge lead fees or receive commissions or a percentage of work arranged through direct contact.
iHandyman does not perform, supervise, direct, inspect, approve, guarantee, or warrant handyman work. Membership does not create employment and does not guarantee inquiries, leads, revenue, ranking, or any amount of work.
3. Direct communication and no messaging access
iHandyman does not operate an internal chat, SMS relay, email relay, call-routing service, or call-recording service between customers and handymen.
When a user chooses to call, text, email, or otherwise contact a handyman, the Service may open the user’s own telephone, messaging application, email application, or another third-party service. The user decides whether to send the communication.
Direct communications take place between the customer and the handyman through their own devices, carriers, applications, and service providers. iHandyman does not send, route, receive, read, monitor, record, or store those communications and does not have access to their contents or response history.
Information sent directly to a handyman is controlled by the sender, the recipient, and the third-party communications service they use. This section does not apply to a review, problem report, support request, or other information separately and intentionally submitted to iHandyman through an iHandyman website feature.
4. Identity verification and profile status
An “Identity Verified” indicator means only that the associated applicant completed the Stripe Identity verification process used by iHandyman and that iHandyman received a verification status or outcome associated with the application.
Identity verification is not a criminal background check, professional background check, licensing check, insurance check, address verification, skill assessment, safety certification, recommendation, or guarantee of trustworthiness or suitability for a particular job.
Identity documents, document images, selfies, biometric identifiers, and information extracted from identity documents are submitted directly to Stripe. iHandyman does not ask applicants to send those materials to iHandyman and does not retrieve, download, copy, store, or review them. iHandyman uses only the verification status or outcome, a Stripe verification reference, and limited metadata needed to associate the result with the correct application. Stripe may make additional verification information technically available within Stripe’s own systems; it is iHandyman’s policy and ordinary practice not to access, retrieve, download, copy, store, or review that additional information.
iHandyman does not verify a business address during registration. Experience, services, service areas, availability, portfolio content, payment methods, languages, and other profile claims may be supplied by the member unless a feature expressly states otherwise.
iHandyman Status is used to manage participation in the directory. It is not a star rating, legal judgment, safety certification, licensing determination, or guarantee. Reviews reflect individual customer experiences. Users must perform their own due diligence before hiring anyone.
5. Customer and visitor responsibilities
When contacting or hiring a handyman, you are responsible for:
- evaluating the handyman and deciding whether the handyman is suitable for the work;
- verifying licenses, registrations, insurance, bonding, permits, and references where relevant;
- agreeing directly with the handyman on scope, price, schedule, materials, warranties, access, cleanup, and payment terms;
- protecting property, personal information, account credentials, and personal safety;
- using lawful and appropriate payment practices; and
- complying with laws that apply to the requested work.
Do not use iHandyman for emergencies. Call 911 or the appropriate emergency service when there is an immediate threat to life, safety, or property.
6. Handyman member responsibilities
Handyman applicants and members must:
- provide accurate application, account, and profile information;
- maintain all licenses, registrations, permits, insurance, bonding, and tax compliance legally required for their work;
- comply with advertising and license-disclosure rules applicable to their jurisdiction; where required, licensed contractors must display their license number, and unlicensed persons must clearly disclose that they are not state licensed and must not advertise, offer, or accept work beyond what may lawfully be performed without a license;
- avoid false, deceptive, or misleading claims and disclose material limitations;
- keep contact information, services, service areas, and availability reasonably current;
- use information received directly from customers only for legitimate service communications and lawful business purposes;
- perform work lawfully, safely, and professionally;
- respect customer property, privacy, and direct communication choices;
- cooperate in good faith with documented problem-report reviews; and
- remain solely responsible for their work, employees, subcontractors, taxes, contracts, warranties, collections, refunds, and disputes with customers.
7. Verification fee, free period, automatic renewal, cancellation, and refunds
One-time fee. A handyman membership applicant is charged a one-time USD 3.88 Verification & Setup Fee when submitting the application and continuing to Stripe. This fee is separate from the monthly membership and is non-refundable after the verification and setup process begins, except where required by law or in the event of a duplicate charge or confirmed technical billing error. Payment of the fee does not guarantee approval or profile publication.
Free membership period. If an application is approved and the profile is published, the first 90 days after profile publication are free. The 90-day period does not begin merely because an application was submitted or the one-time fee was paid.
Automatic monthly renewal. Unless canceled, membership automatically continues after the free period at USD 19.99 per month, plus any applicable taxes, using the payment method maintained through Stripe. Each paid membership period automatically renews monthly until canceled.
Before authorizing the recurring membership, the applicant must affirmatively agree to the automatic-renewal terms presented during registration or checkout. iHandyman may retain a record of that consent as required by law.
iHandyman will provide renewal, trial-expiration, annual, and price-change notices when and within the time periods required by applicable law. A notice does not replace the member’s ability to cancel at any time.
Cancellation. A member who enrolled online may cancel online at any time through the available membership or subscription controls in the member’s account, without steps designed to obstruct or delay cancellation. Cancellation stops future automatic renewals.
- If membership is canceled during the free period, the first monthly membership charge will not occur.
- If membership is canceled during a paid monthly period, the cancellation generally takes effect at the end of that paid period, and no further monthly renewal will be charged.
- Deleting an account or removing profile content does not necessarily cancel an active subscription. The member must use the membership cancellation control or other cancellation method expressly provided by iHandyman.
Refunds. Monthly membership fees already charged are generally not prorated or refunded, except where required by law, in the event of a duplicate charge or confirmed technical billing error, or where iHandyman expressly approves a refund. Nothing in these Terms limits any non-waivable refund or cancellation right.
Failed payments and price changes. We may retry a failed payment through Stripe and may restrict or hide a profile if membership payment remains unpaid. Any membership-price change will apply prospectively after the notice and consent, if any, required by applicable law.
8. User content and limited license
You retain ownership of content you submit, including profile information, photographs, videos, projects, reviews, ratings, responses, and problem-report materials.
You grant iHandyman a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, crop, compress, transcode, technically format, display, distribute, and make available your content only as reasonably necessary to operate, secure, maintain, and provide the iHandyman features you select or use. This includes displaying content in the relevant profile, search result, city page, portfolio, project, review, availability, status, account, moderation, safety, and link-preview functions.
iHandyman will not use profile photographs, portfolio media, review photographs, or other submitted content in an unrelated advertising or promotional campaign without separate permission from the person who submitted the content or otherwise owns the necessary rights.
The license ends when the content is deleted from the Service, except to the extent reasonably necessary for ordinary backups, security, legal compliance, disputes, enforcement, or content already distributed publicly at the user’s direction. Search engines, browsers, archives, recipients, or other third parties may retain copies outside iHandyman’s control.
You represent that you have all rights, permissions, releases, and lawful authority necessary to submit the content and grant this license. Submitted content must not violate any person’s privacy, publicity, copyright, trademark, contractual, or other rights.
9. Reviews, problem reports, and moderation
Reviews and ratings reflect the individual opinions and experiences of the people who submit them. iHandyman does not guarantee that every review, rating, response, profile statement, or report is complete, accurate, or representative.
iHandyman may moderate, restrict, label, hide, or remove content that reasonably appears unlawful, fraudulent, misleading, abusive, irrelevant, duplicative, unsafe, privacy-invasive, infringing, or inconsistent with these Terms.
iHandyman may receive and review documented problem reports to manage directory participation and profile status. We may share relevant report information with the affected handyman when reasonably necessary to explain the issue, request a response, conduct a fair review, protect users, or enforce these Terms.
iHandyman does not process refunds for handyman work, award compensation, act as a court or arbitrator, provide legal conclusions, or decide civil or criminal liability. Submitting a report does not guarantee a particular status change or result.
10. Prohibited conduct
You may not use the Service to:
- deceive, defraud, impersonate, threaten, exploit, harass, or unlawfully discriminate against another person;
- submit false applications, reviews, reports, evidence, identity information, or profile claims;
- manipulate ratings, reviews, availability, status, search results, or account eligibility;
- upload malware, malicious code, or content intended to damage, disrupt, or gain unauthorized access;
- interfere with authentication, payment, identity verification, security, rate limits, or abuse-prevention controls;
- scrape, harvest, copy, or systematically collect profiles, contact information, media, reviews, or other data at scale without written permission;
- collect or use personal information for unrelated advertising, spam, resale, data brokerage, or unlawful purposes;
- publish unlawful, infringing, confidential, highly sensitive, or privacy-invasive content;
- use another person’s account without permission; or
- attempt, assist, or encourage any violation of these Terms or applicable law.
11. Suspension, profile restrictions, and termination
We may restrict, hide, hold, suspend, or terminate access, an account, an application, or a profile when reasonably necessary to:
- protect users or the Service;
- investigate suspected fraud, abuse, impersonation, or security threats;
- review documented reports or patterns of concern;
- enforce these Terms;
- respond to legal requirements;
- address a failed or disputed membership payment;
- remove abandoned, materially incomplete, or misleading profiles after appropriate notice where practicable; or
- maintain the integrity and reliability of the directory.
Where appropriate, we may provide notice or an opportunity to respond. Urgent safety, fraud, security, or legal action may occur before notice.
You may stop using the Service at any time. Account deletion, profile removal, content deletion, and membership cancellation are separate actions and may have different consequences.
12. Third-party services
The Service relies on independent providers, including Stripe for payments, subscriptions, fraud prevention, and identity verification; Cloudflare for security, content delivery, and media storage or delivery; website and database hosting providers; and transactional email, infrastructure, and security providers.
Their own terms and privacy practices may apply when they process information or provide their services. iHandyman is not responsible for independent third-party services, websites, payment applications, carriers, email providers, messaging applications, or other systems outside iHandyman’s reasonable control.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” IHANDYMAN DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
IHANDYMAN DOES NOT WARRANT OR GUARANTEE THAT:
- a handyman is licensed, insured, bonded, qualified, safe, reliable, available, or suitable for a particular job;
- profile information, reviews, ratings, status, availability, search results, reports, or third-party information are complete, current, accurate, or error-free;
- the Service will be uninterrupted, secure, or free from technical errors;
- a customer or handyman will respond, enter an agreement, perform work, make payment, provide a refund, or resolve a dispute; or
- membership will produce leads, inquiries, revenue, ranking, or work.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IHANDYMAN AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, BUSINESS, OPPORTUNITY, OR REPUTATION; OR COSTS OF SUBSTITUTE SERVICES, ARISING FROM OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IHANDYMAN WILL NOT BE LIABLE FOR CLAIMS, LOSSES, INJURIES, PROPERTY DAMAGE, DEFECTIVE WORK, DELAYS, NONPAYMENT, REFUNDS, DISPUTES, OR OTHER HARM ARISING FROM OR RELATING TO:
- the acts or omissions of a customer, handyman, employee, subcontractor, or other third party;
- direct communications, agreements, payments, or work between customers and handymen;
- profile claims, reviews, ratings, availability, status information, or user-submitted content;
- third-party services or systems outside iHandyman’s reasonable control; or
- unauthorized account access not caused by iHandyman’s legally actionable conduct.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IHANDYMAN’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) USD 100; OR (B) THE AMOUNT YOU PAID DIRECTLY TO IHANDYMAN DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO IHANDYMAN’S FRAUD, WILLFUL INJURY OR WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. Some jurisdictions do not allow certain exclusions or limitations, so some portions of this section may not apply to you.
15. Indemnification
Handyman members and business users. To the extent permitted by law, a handyman applicant, handyman member, or person using the Service on behalf of a business agrees to defend, indemnify, and hold harmless iHandyman and its owners, officers, directors, employees, contractors, and agents from third-party claims, damages, judgments, penalties, liabilities, and reasonable legal expenses arising from or relating to:
- the applicant’s or member’s work, estimates, contracts, warranties, employees, subcontractors, taxes, licensing, insurance, permits, payments, refunds, collections, or customer disputes;
- content, profile claims, photographs, videos, or other materials submitted by or for the applicant or member;
- the applicant’s or member’s direct communications or use of customer information;
- the applicant’s or member’s violation of law, third-party rights, or these Terms; or
- fraud, misconduct, or negligence attributable to the applicant, member, employee, subcontractor, or representative.
Other users. To the extent permitted by law, a user who is not a handyman member or business user is responsible for third-party claims caused by that user’s fraud, intentional misconduct, unlawful content, knowing infringement of third-party rights, false report, or material violation of these Terms.
No user is required to indemnify iHandyman for iHandyman’s own fraud, willful misconduct, gross negligence, or violation of law. iHandyman may assume control of the defense of a covered claim using counsel of its choice, and the responsible party must reasonably cooperate. No settlement imposing liability, admission, or non-monetary obligation on iHandyman may be entered without iHandyman’s prior written consent.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to any non-waivable venue or jurisdiction right, a legal action arising from or relating to these Terms or the Service may be brought in the state courts located in Sacramento County, California, or, where federal subject-matter jurisdiction exists, in the United States District Court for the Eastern District of California. The parties consent to personal jurisdiction in those courts.
These Terms do not require arbitration and do not contain a class-action waiver. Nothing in these Terms prevents a party from bringing an eligible claim in small claims court or exercising another right that cannot lawfully be waived.
17. Changes to the Service or Terms
We may modify, add, remove, suspend, or discontinue Service features prospectively, subject to applicable law and any active paid membership commitments.
We may update these Terms prospectively. We will post the revised Terms and update the “Last Updated” date. We will provide additional notice and obtain renewed consent when required by law. A material change will not retroactively alter an existing dispute unless legally permitted and agreed by the affected parties.
18. General terms
These Terms, the Privacy Policy, and any additional terms clearly presented and accepted for a specific feature constitute the agreement governing that feature. If specific billing terms accepted at checkout conflict with these Terms, the specific billing terms control only for that billing issue.
If any provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. Headings are for convenience only.
You may not assign these Terms without iHandyman’s written consent. iHandyman may assign these Terms as part of a merger, acquisition, financing, reorganization, or transfer of business assets, subject to applicable law and the privacy commitments communicated to users.
No person other than you and iHandyman has a right to enforce these Terms, except an iHandyman party expressly protected by the disclaimer, limitation-of-liability, or indemnification provisions.
